Ellen Mariani’s most recent filings.  Except for the three briefs which were filed with the US Supreme Court (as noted below) all of the following briefs were filed with the Second Circuit Federal Court of Appeals:

7/8/13:  The Second Circuit Federal Court of Appeals issued an order which: (1) denied Bruce’s 6/20/13 Motion For An Order Vacating The 6/14/13 Order And Asking The Court To Reconsider The Rulings (dated 5/30/13 and 6/14/13) Which Prevented The Filing Of The Petition For Rehearing En Banc; and (2) partially granted Bruce’s 6/20/13 Motion For An Order Vacating The 6/14/13 Order And Asking The Court To Reconsider The Rulings (dated 5/30/13 and 6/14/13) Which Prevented The Filing Of The Petition For Rehearing En Banc.  Click here to review the 7/8/13 order.

6/20/13: Bruce filed a Motion For An Order Vacating The 6/14/13 Order And Asking The Court To Reconsider The Rulings (dated 5/30/13 and 6/14/13) Which Prevented The Filing Of The Petition For Rehearing En Banc.

6/20/13: Bruce filed an Emergency Motion For An Order Requiring That All Future Motions In This Case Be Considered By Different Judges From Those Who Issued The 5/15/13 Decision.

6/14/13:  The court issued an order denying Bruce Leichty’s Motion To Overrule Notice Of Defective Filing and Allowing Filing of Petition For Rehearing En Banc.

5/31/13:  Bruce Leichty, Ellen Mariani’s attorney, was forced to file a special motion just to file his Petition For Rehearing En Banc and to have the petition considered by the court because the Clerk of the Court, Catherine Wolfe, refused to allow him to file his petition.  This special motion is titled MEMORANDUM OF APPELLANT ELLEN MARIANI IN SUPPORT OF EMERGENCY MOTION FOR ORDER OVERRULING NOTICE OF DEFECTIVE FILING, ALLOWING FILING OF PETITION FOR EN BANC REHEARING, AND FOR RECALL OF MANDATE IF NEEDED.  (It includes as attachments the following documents:  (1) An affidavit from Bruce Leichty [pp. 7-18 of that affidavit refute many of the extreme and outlandish allegations against Bruce and Ellen by Judges Susan Carney and Peter Hall in their 5/15/13 order]; (2) the Notice of Defective Filing issued by Clerk Catherine Wolfe; (3) the Petition For Rehearing En Banc; (4) the 5/15/13 order of the Second Circuit Court of Appeals; (5) the 6/26/12 order of the Second Circuit Court of Appeals.)

5/30/13:  The clerk of the court, Catherine Wolfe, refused to allow Bruce to file the Petition For Rehearing which he attempted to file on 5/29/13.  She issued a Notice of Defective Filing to Bruce.

5/29/13: Bruce attempted to file Petition For Rehearing En Banc of the 5/15/13 order (and of the 6/16/12 order).  (The fact that Bruce sought a Petition For Rehearing En Banc means that he was seeking a hearing before a full panel of judges, not just the two who reviewed his prior briefs.)

5/15/13: A two judge panel of the Second Circuit Federal Court of Appeals (Judges Peter Hall and Susan Carney) finally issued a final decision on its order to show cause dated 6/26/12.  This decision issued monetary sanctions against Bruce Leichty as well as Ellen Mariani and it very harshly castigated Bruce, saying that he was “anti-Semitic”, that he acted with “bad faith” and that he filed frivolous briefs.  The order was very hostile to Bruce and Ellen.  Click here to read it.

7/24/12 — A nasty letter to the court by John Ransmeier urging the court to issue sanctions against Ellen and Bruce.

7/5/12 — Ellen Mariani’s and her attorney Bruce Leichty’s responses to the Second Circuit Court of Appeals’s 6/26/12 order explaining why each of them should not be sanctioned by the court.

6/26/12 — The Second Circuit Court of Appeals’s order denying the appeal of Ellen Mariani of the rulings of Judge Hellerstein denying motions of Ellen Mariani to intervene and challenging settlement.  (Note: This order becomes quite hostile on p. 6 and it threatens sanctions against both Ellen and her attorney, Bruce Leichty.  This is in response to Ellen’s 4/19/12 motion which revealed conflicts of interest on the part of Judge Hellerstein.)

6/26/12 — The Second Circuit Court of Appeals’s order denying Ellen Mariani’s motion to supplement the record with new evidence.

5/16/11 — Order of a three judge panel of the Second Circuit Court of Appeals dated 5/16/11 (Judge Ralph K. Winter, Judge John M. Walker, Jr., and Judge Jose A. Cabranes) denying attorney John Ransmeier’s motion to dismiss Ellen Mariani’s appeal of Judge Hellerstein’s orders.  (A question for the reader: Since this three judge panel of the Second Circuit Court of Appeals denied attorney Ransmeier’s motion to dismiss Ellen Mariani’s appeal, this means that they effectively ruled that the appeal could be pursued and implied that the issues raised were not frivolous.  So, then how does it make any sense that in a subsequent appeal of Ellen Mariani based on some of the same arguments as the first appeal [as well as signifiicant new evidence] another panel of judges from this same court issued an order dated 6/26/12 which threatened to issue sanctions against both Ellen Mariani and her attorney Bruce Leichty for allegedly filing a frivolous appeal?)

2/22/11 — Ellen Mariani’s opposition to attorney John Ransmeier’s 2/14/11 motion to dismiss her appeal.

2/17/11 — Notice of appeal of Judge Hellerstein’s order settling the Estate and awarding attorney’s fees that was consolidated with the notice of appeal filed on 1/13/11.

2/14/11 — Attorney John Ransmeier’s (Adminstrator of Louis Neil Mariani’s estate) motion to dismiss Ellen Mariani’s appeal.

1/13/11 — Ellen Mariani’s notice of appeal of several orders of Judge Hellerstein, including orders approving the settlement of Louis Neil Mariani’s estate, denying Ellen’s motion to re-enter the case as an intervenor, and denying her attorney Bruce Leichty’s motion to be admitted as attorney Pro Hac Vice for Ellen.
